In a significant blow to the Peoples Democratic Party (PDP) in Edo state, a Federal High Court in Abuja has declared the party’s February 2024 gubernatorial primary election to be unlawful and invalid.

According to reports from DAILY POST, the primary, which saw Asue Ighodalo emerge as the PDP’s governorship candidate, was voided by Justice Inyang Edem Ekwo on grounds that 378 eligible delegates were unlawfully prevented from participating.

The ruling came in a suit filed by Hon. Kelvin Mohammed on behalf of the aggrieved delegates, who argued that the primary election held at the Samuel Ogbemudia stadium in Benin City had violated both the Electoral Act 2022 and the PDP’s own internal guidelines.

In his judgment, Justice Ekwo agreed that the exclusion of the 378 delegates was improper and fatally undermined the integrity of the primary process.

He declared that both the provisions of the Electoral Act 2022 and the PDP Guidelines were grossly violated in the conduct of the primary election
